Berlin, July\u00a020, 2021.<\/strong> The principle of strict liability is a core and important component of an effective fight against doping.\u00a0The\u00a0documentary<\/a>\u00a0and the experiment by the ARD doping editorial team and the Institute of Forensic Medicine at the University Hospital of Cologne have impressively illustrated the negative effects this principle can have on athletes who have a positive doping result through no fault of their own. It has now been shown experimentally how doping attacks can be carried out unnoticed and effectively. Positive doping tests were detected after a short time as well as over a longer period in a large number of cases.<\/p>\n

Unnoticed doping attacks make it almost impossible for affected athletes to prove their innocence. Destroyed careers, immense psychological suffering and irreparable damage to personal reputation can be the consequences.<\/p>\n

There are undoubtedly both\u00a0valid\u00a0and important reasons for the principle of strict liability to make the fight\u00a0against doping\u00a0as effective as possible.\u00a0This principle shifts the burden on the athletes who must convincingly proof their innocence\u00a0after a positive doping test.\u00a0At the same time, we must be aware that\u00a0adherence to strict\u00a0liability\u00a0accepts\u00a0sanctioning innocent\u00a0athletes as collateral damage. The findings of the documentary make it glaringly clear that the\u00a0anti-doping\u00a0regime\u00a0can be in conflict with the presumption of innocence enshrined in human rights law. For some time now, we have\u00a0been calling with other\u00a0athlete groups<\/a> for the WADA Code to be subjected to a human rights impact assessment.<\/p>\n

There is no doubt that a debate on the principle of strict liability in the\u00a0anti-doping\u00a0fight is necessary after the latest revelations. It should be\u00a0conducted\u00a0in a nuanced and objective manner.\u00a0Ultimately, it must be clarified whether and\u00a0if so,\u00a0what\u00a0kind of\u00a0adjustments could be made to safeguard the fundamental rights of athletes and at the same time not to jeopardize the effectiveness of the\u00a0anti-doping\u00a0system. We welcome NADA’s announcement that the results of the experiment will be taken into account in\u00a0the\u00a0results management and\u00a0in\u00a0disciplinary proceedings and that analytics will be more focused on\u00a0the unintentional\u00a0ingestion of substances. We join NADA in requesting an immediate and appropriate response from WADA as the central\u00a0rule maker.<\/p>\n

In the future, it must be made easier for athletes to prove their innocence. For example, they could receive increased assistance in proving their innocence and\u00a0enhanced legal aid. Those who are innocent should receive redress for the harm inflicted and the suffering they have endured. In addition, the investigative and analytical capacities of\u00a0anti-doping\u00a0organizations must continue to be strengthened.<\/p>\n","protected":false},"excerpt":{"rendered":"
